TERMS & CONDITIONS: This document sets forth the entire agreement between Colorado Green Plumbing, LLC (“CGP”) and the Customer. This Agreement cannot be changed without written approval from CGP. Except as otherwise provided by this Agreement, no prior or subsequent oral or written representations or promises made by any person shall serve to modify or amend this Agreement.
PAYMENT TERMS: Customer agrees to pay CGP upon completion of work covered by this Agreement with cash, check, credit card, or financing provided through CGP. Payments not received upon completion shall be considered past due and subject to collection. In the event of nonpayment, all costs related to collection, including reasonable attorney fees, shall be added to the unpaid balance. Customer checks returned as uncollectible are subject to a $20.00 fee plus the original amount. Payment of the amount owed, plus the fee, shall be made in cash, money order, or cashier’s check only, no later than twelve (12) days from notification. All amounts due shall bear interest at 1% per month or the maximum rate permitted by law, whichever is less. Customer agrees to pay all court costs and reasonable attorney’s fees for collection.
ESTIMATES: All estimates are based on visible conditions at the time of inspection and are subject to change upon discovery of hidden or unforeseen conditions, including but not limited to pre-existing damage, hazardous materials, or code violations.
MECHANICS' LIEN RIGHTS: Customer acknowledges that CGP may have the right to file and enforce a mechanics' lien against the property for labor, materials, equipment, permits, or services furnished and not paid for in accordance with Colorado law.
RIGHT TO STOP WORK: CGP reserves the right to stop work or terminate services if unsafe conditions, hazardous materials, customer interference, abusive conduct, unforeseen site conditions, or nonpayment are encountered. Customer shall remain responsible for payment for all work performed and materials provided prior to termination.
CHANGE ORDERS: Any changes, additions, or modifications to the scope of work must be agreed to in writing by both parties and may result in additional charges and adjustments to the timeline.
PERMITS AND INSPECTIONS: Where required by applicable law or local jurisdiction, it is the responsibility of the Customer to ensure that all necessary permits are obtained prior to the commencement of work. CGP may obtain required permits on behalf of the Customer as an additional service. If CGP pulls the permit, a permit administration fee equal to 10% of the invoice total will be charged to the Customer, in addition to any fees charged by the applicable jurisdiction. This fee covers CGP's time, administrative costs, and coordination with inspectors.
If the Customer elects to pull the permit independently, the Customer assumes full responsibility for obtaining the correct permit(s), ensuring timely inspections, and compliance with all applicable codes and jurisdictional requirements. CGP shall not be responsible for delays, fines, stop-work orders, or failed inspections arising from the Customer's failure to obtain proper permits or schedule required inspections in a timely manner.
All work performed by CGP shall comply with applicable codes at the time of installation. CGP makes no representation that existing systems, structures, or conditions on the Customer's property meet current code requirements, and any upgrades required to bring pre-existing conditions into compliance shall be treated as additional work subject to a separate Change Order.
WARRANTY:
CGP guarantees that the work covered by this Agreement shall be performed in a competent, workmanlike manner and shall be free of defects in workmanship and CGP-provided materials for a period of one (1) year from the date of completion, unless otherwise specified. CGP warranty is available only to the ORIGINAL PURCHASER. Extended warranties through CGP end upon sale of the home. Failure to properly maintain equipment may void CGP’s labor warranty coverage. Manufacturer warranties are subject to the manufacturer’s terms and conditions. Normal maintenance, including check-ups and filter replacements are the responsibility of the Purchaser. Equipment, fixture, or system failures resulting from lack of proper maintenance, freezing, misuse, abuse, neglect, alteration, or causes beyond CGP's control are excluded from warranty coverage. CGP provides no warranty, express or implied, on existing equipment, ductwork, piping, fixtures, or materials not installed by CGP. There is no warranty on customer-provided parts.
WARRANTY ON DRAIN STOPPAGES: Drains cleared by CGP are guaranteed to remain unplugged for thirty (30) days, except when the following conditions exist: misuse of the drain system by Customer, low spots in the drain line, faulty or defective fixtures/pipes, or broken sewer/drain lines. Residential toilets are guaranteed for seven (7) days.
All warranty work shall be performed during CGP’s normal working hours.
LIMITATION OF LIABILITY: CGP is not responsible for any damage to property caused by the removal of fixtures, drains, pipes, or appurtenances that, in CGP’s sole opinion, are so deteriorated they require repair or replacement after removal. In such cases, CGP will notify the Customer. If Customer authorizes repair or replacement thereof, it shall be at an additional charge. If the Customer refuses to authorize the additional repair or replacement, CGP shall not be responsible for any resulting damages such as sewer gas, backups, or leaks.
Customer understands that CGP may need to gain access to fixtures, drains, piping, etc. through walls, ceilings, floors, tile, etc. and any repairs to those surfaces are the Customer’s sole responsibility unless otherwise agreed to in writing.
CGP shall have no liability for any damage, delays, claims, or failure to perform arising from conditions or events beyond its reasonable control, including but not limited to weather, fire, flood, labor shortages, material shortages, utility interruptions, permit delays, acts of God, supplier delays, pre-existing hazardous materials (including asbestos-containing materials (ACM), lead, or mold), leaky, defective, deteriorated, or illegal existing plumbing systems, corrosion, hard water buildup, or deteriorated drain, sewer, or piping systems.
To the extent permitted by law, CGP shall have no liability for indirect or consequential damages arising from, or related to, any malfunction or defect of the goods, materials, or services provided, pursuant to this agreement, including loss of rent, utility costs, relocation expenses, or claims by third parties. CGP’s total liability under this Agreement shall be limited to the removal of equipment installed by CGP and a full refund of the purchase price paid.
Customer agrees to mitigate any damage, including immediately shutting off water, or the system, if a leak is discovered. Customer further assumes the inherent risks of damage to pipes and fixtures that can occur when clearing drain or sewer lines.
HAZARDOUS MATERIALS AND PRE-EXISTING CONDITIONS: Customer acknowledges that buildings constructed prior to 1980 may contain hazardous materials, including asbestos-containing materials (ACM), lead-based paint, mold, or other regulated substances. CGP is a plumbing contractor and is not a certified asbestos abatement contractor, environmental inspector, or hazardous materials specialist.
INSURANCE AND DAMAGES: CGP shall have, in force, workers’ compensation and liability insurance as required by law. Any damage done to the Customer’s property by employees of CGP shall be reported, in writing, immediately. Customer agrees to allow CGP’s insurance provider to investigate said damage to assess liability and/or damages, if any, claimed by Customer. CGP reserves the right to clean, repair or replace any items damaged at CGP’s discretion.
GOVERNING LAW AND VENUE: This Agreement shall be governed by the laws of the State of Colorado. Any legal action arising from this Agreement shall be brought in a court of competent jurisdiction located in the county where CGP's principal office is located, unless otherwise required by law.
